The interested party, as this is a very personal right, and in all cases the identity of the interested party must be accredited.
The interested party's legal representative on behalf of the interested party, when the interested party is incapacitated or a minor, in which case it will be necessary for the legal representative to accredit this condition. Personal data of the interested party shall not be communicated to third parties who do not provide documentation accrediting the incapacity or the fact that the interested party is a minor and that they are the interested party's legal representative.
The voluntary representative. In this case, the identity of the person being represented must be clearly accredited, by providing a copy of their National Identity Document or equivalent document, and the representation conferred by them.
The interested party shall exercise their rights by means of a request addressed to the File or Processing Controller. The request shall be addressed to the corresponding Department or Directorate before which the rights of access, rectification, erasure, objection and limitation indicated in the different privacy notices or data protection policies in which data subjects are informed of the aspects indicated in Art. 13 of the GDPR may be exercised. The management of this request will be centralised at the address detailed below. Likewise, in the event that an interested party asks any ADIF staff member how to exercise these rights or raises the need to do so, they shall be directed to the aforementioned address. The application must contain the following information and/or documentation:
Name and surname(s) of the interested party.
Photocopy of their National Identity Document or alternative documentation that accredits their identity.
Photocopy of the National Identity Document of the person representing the interested party in cases of incapacity in which such representation is required, as well as a document accrediting the representation.
Specific request or right being exercised.
Address for the purpose of notifications.
Date and signature of the applicant.
Documents accrediting the petition, if applicable.
Means or system through which access to the personal data is sought.
In cases in which access, rectification, cancellation or objection to the processing of personal data of images of identified or identifiable natural persons is requested, the request must include an updated photograph of the interested party.
In the event that the interested party exercises their right to cancellation, they must indicate in the corresponding request whether the data is erroneous or inaccurate or whether they revoke their authorisation for the processing of the data, if this was the reason for its collection.
