Royal Decree 2395/2004of 30 December, modified on several occasions, the last one by Royal Decree 1044/2013 of 27 December, approves the statute of the public business entity Administrator of Railway Infrastructures (ADIF, as per its acronym in Spanish). Article 15 establishes the composition of the board of directors, article 16 stipulates the powers of the board and article 21 provides that the board members attening the board of directors' sessions shall receive a financial compensation authorized by the Minister of Finance and Civil Service.
On the other hand, article 28.1 of Royal Decree 462/2002 of 24 May on compensation for service, establishes that the Minister of Finance and Civil Service may authorize, exceptionally, an additional pay for attending meetings of public agencies' governing bodies.
Likewise, Royal Decree 451/2012 of 5 March, which regulates the remuneration regime of top managers and executives in the business public sector and other entities, classifies agencies into three groups according to criteria established in the royal decree. The rule also stipulates that the category in which the agency is classified will determine the number of members in the governing body. The category will also be taken into account for setting the maximum amount to be paid for attending meetings held by the governing body, in accordance with the provisions of article 28 of Royal Decree 462/2002 of 24 May on compensation for service. Royal Decree 451/2012, developed by Order of April 12, 2012 of the Minister of Finance and Civil Service, places the public business entity Adif in Group 1 of the aforementioned Order.
Based on the foregoing, successive resolutions have been issued by the State Secretariat for Budgets and Expenditures, extending the authorization contained in the resolution of January 18, 2005, to proceed with the payment of compensations for attending the meetings of the board of directors.
The last authorization was issued through a resolution of the State Secretariat for Budgets and Expenditures, on February 9, 2018, which established that the provisions of the resolution of the State Secretariat for Budgets and Expenses of December 9, 2016 would also be valid during 2018 and 2019. This resolution extended the authorization contained in the resolution of December 29, 2014, which authorized the payment of compensations to Adif's board members for attending the board of directors' meetings, for a maximum amount of € 11,523.27 per year, for a total of 11 sessions. This limit will be reduced proportionally if the number of sessions is less than eleven.
